Nell’ambito delle cause di separazione o divorzio, l’attribuzione dell’assegno di mantenimento o dell’assegno divorzile all’ex coniuge non è automatica, ma subordinata a specifici criteri di valutazione del reddito e del contributo fornito dal coniuge economicamente più debole al ménage domestico. Questo aspetto è stato recentemente chiarito dalla Corte di Cassazione con l’ordinanza n. 12953/2024 del 13 maggio 2024, che ha rigettato la richiesta di assegno di divorzio da parte di una ex moglie il cui reddito era solo leggermente inferiore a quello del marito. La Corte ha così spiegato quando l’ex coniuge non può pretendere il mantenimento. Nel caso di specie non vi era un sostanziale squilibrio economico tra le parti. Difatti presupposto essenziale per ottenere l’assegno è l’incapacità del richiedente di mantenersi da solo, ciò che tecnicamente viene chiamata “non autosufficienza economica”. Sicché una piccola disparità di redditi non è sufficiente per giustificare l’assegnazione dell’assegno di divorzio. Ad esempio, se il marito guadagna 2.000 euro al mese e la moglie 1.600, quest’ultima non avrà diritto agli alimenti. Infatti il suo stipendio, per quanto inferiore – ma non di molto – le consente comunque un’adeguata indipendenza. Per la Cassazione, il riconoscimento dell’assegno di divorzio (che ha una funzione assistenziale, compensativa e perequativa) dipende principalmente da due condizioni: l’effettiva inadeguatezza dei mezzi dell’ex coniuge richiedente; la sua impossibilità oggettiva di procurarseli. Tale impossibilità non deve cioè dipendere da un atteggiamento colpevole della moglie. Cosa che avviene, di norma, quando quest’ultima non ha “potenzialità reddituali” per ragioni collegate alla salute, all’età o alla mancanza di formazione. Ma soprattutto è ciò che succede quando la donna ha sacrificato la carriera per badare alla famiglia, rinunciando alla propria crescita professionale e lavorativa. Ed è proprio questa l’ipotesi più frequente in cui i giudici riconoscono, all’ex moglie non più giovane, l’assegno divorzile. I criteri per decidere sull’attribuzione e sulla quantificazione dell’assegno includono una valutazione comparativa delle condizioni economico-patrimoniali di entrambe le parti, considerando sia il contributo di ciascuno alla vita familiare sia alla formazione del patrimonio durante il matrimonio. E non solo: a incidere è anche la durata del matrimonio, tenuto però conto anche dell’eventuale periodo di convivenza prematrimoniale. Inoltre, ma non in ultimo, il ruolo dell’assegno di divorzio non è quello di ricreare il tenore di vita del periodo coniugale, ma di garantire solo quel minimo per una vita decorosa (appunto l’autosufficienza) o riconoscere e compensare l’apporto che l’ex coniuge economicamente più debole ha dato dalla famiglia. Questo principio garantisce che l’assegno divorzile sia utilizzato per equilibrare le situazioni finanziarie post-matrimonio in modo equo e giusto, tenendo conto di tutte le variabili e contributi personali. Ultima ipotesi in cui l’ex coniuge non può pretendere il mantenimento: quando, nella causa di separazione, subisce il cosiddetto “addebito” ossia l’imputazione di responsabilità per la fine del matrimonio. Questo avviene di norma in caso di tradimento, abbandono della casa coniugale, violazione del dovere di contribuzione, di assistenza morale e materiale, violenze fisiche o morali.

L’accesso del datore alle mail aziendali del dipendente è un tema delicato, regolato dal Jobs Act e dal GDPR per garantire, da un lato, la tutela del patrimonio aziendale e, dall’altro, la privacy dei lavoratori. Recenti sentenze hanno chiarito quando il datore di lavoro può leggere le mail dei dipendenti ed effettuare controlli per elevare contestazioni disciplinari. In questo articolo, vedremo come funzionano i controlli sugli strumenti informatici in uso ai lavoratori, quali sono le condizioni per l’accesso all’account di posta elettronica aziendale dato in uso al dipendente e quali sono le conseguenze di una raccolta di prove avvenuta in modo illecito. Ma procediamo con ordine. Il datore può accedere alla mail aziendale del dipendente senza motivo? Il datore di lavoro non può accedere alla mail aziendale del dipendente senza un motivo valido. Secondo la giurisprudenza (ad es. Trib. Roma, sent. n. 1870/2024 del 14 febbraio 2024) egli può acquisire informazioni dalle mail aziendali del dipendente solo se vi è un “fondato sospetto” di condotta illecita e unicamente a partire da tale momento. Pertanto sono illeciti: * i controlli a ritroso, ossia eseguiti prima che il sospetto si sia manifestato; * gli accessi esplorativi, indiscriminati e in modalità “random”, fatti al solo scopo di prevenire violazioni disciplinari. Qualsiasi informazione ottenuta in modo illecito non può essere utilizzata in un eventuale giudizio. Quali sono le conseguenze di un accesso illecito alle mail aziendali? Se un datore di lavoro accede illecitamente alle mail aziendali di un dipendente, violando il GDPR (il regolamento europeo sulla privacy), le informazioni così acquisite non fanno prova. Sicché, semmai il dipendente dovesse contestare la sanzione disciplinare – come nel caso di un licenziamento motivato proprio sulla base delle informazioni acquisite tramite l’accesso all’email aziendale – la sanzione stessa deve essere annullata. Quali sono le condizioni per il controllo delle mail aziendali? Sicuramente il datore di lavoro non può controllare gli strumenti informatici personali dei dipendenti, come tablet e smartphone. Le verifiche a distanza possono riguardare solo il materiale fornito dall’azienda stessa. Con riferimento a tali dotazioni, il datore di lavoro non necessita della preventiva autorizzazione dei sindacati per controllare le mail aziendali, ma deve informare preventivamente i dipendenti della possibilità di tali controlli.
